General Terms and Conditions

www.TempEmp.co (“TempEmp”) is an independent website operated by TempEmp Limited who is a company registered in England and Wales under registration number 038-739133. The registered office is International House, 24 Holborn Viaduct, London EC1A 2BN. The following terms and conditions (“Terms”) are for users (“General User”) and set out the relationship between TempEmp and you (“You”, “Your” or “General User”).

By using this website and our Service, You acknowledge and agree to these Terms and Our Privacy and Cookie Policy. If You do not agree with these Terms, please do not use this site. By using this Service You are bound to and are deemed to have understood the following;

  • TempEmp provides an online service for individuals and businesses to connect for jobs and tasks that need to be completed.
  • Job Seekers and Employers are in direct contact with each other in relation to the job or task which needs completing
  1. Charges for using TempEmp
    • TempEmp offers a platform for Employers and Job Seekers to connect.
    • TempEmp is currently a free service for both Employers and Job Seekers, however, TempEmp reserve the right to charge for this service at any time.
    • In the event that TempEmp imposes a charge for the service, these Terms shall be updated and amended. If You do not wish to continue to use the Service at this time, you may close your account and cease using TempEmp.
  2. Payment for tasks and jobs
    • Where a job, project or task has been completed, payment for the same shall be organised between the Employer and the Job Seeker.
    • Job Seekers are responsible for organising payment of their own taxes and insurance and shall do so in line with the laws and legislations of the relevant countries.
  3. User Obligations
    • As a General User of TempEmp you shall have access to browse and contact other registered users through the Portal depending on whether you register as an Employer or a Job Seeker.
    • Employers and Job Seekers shall be required to register with TempEmp by creating an account. Job Seekers may use their Facebook or LinkedIn credentials to log into the platform.
    • Users warrant to provide their full and correct details and shall ensure that details are updated at all times.
    • Users understand and accept that whilst TempEmp do not use personal information for any advertising or marketing purposes, all data is stored on the platform and is protected by our Data Protection and Privacy Policies.
    • Employers understand and accept that they appoint the services of the Job Seeker at their own risk and understand that TempEmp accept no responsibility or liability for the outcome of such service.
    • TempEmp provide a space for Job Seekers and Employers to advertise but do not perform background checks or verify the Users. Users accept and understand that any User they contact or engage with is a separate entity to TempEmp and are in no way related to TempEmp.
    • Users are able to leave feedback for each other. Feedback is not checked by TempEmp, however, any feedback which is flagged as being inappropriate, enticing hatred, illegal or immoral shall be removed without notice.
    • Notwithstanding clause 1.7 above, you agree that any feedback left on the platform shall not be explicit, immoral or provoke any kind or racism, hate or other criminal action.
    • Users are prohibited from contacting each other directly once the job, project or task has been completed and invoices raised and settled. Future projects and tasks should be placed through TempEmp and users who are found to be in breach of this clause shall be removed from the platform.
  4. TempEmp Obligations
    • We may change these Terms from time to time. We will give You notice of any changes by posting those changes on Our website. We will not vary any terms which You previously agreed whilst using this website. However, any amended Terms will apply to Your use of this website from the date they are posted and if You do not agree with the amended Terms, You are entitled to stop using this website at that time.
    • The relationship between TempEmp and You exists only with Us as an introductory platform and You as a User.
    • TempEmp endeavours to provide a platform on which Employers and Job Seekers may contact each other for the purposes of filling an appointment or completing a project. TempEmp shall have no interaction with either User, or be party to any communication between the Job Seeker and Employer, once the pair have established a line of communication.
    • These Terms and Conditions and Our correspondence with You will be communicated in the English language.
    • Whilst TempEmp cannot accept any responsibility for the content of feedback and ratings left on the platform by users, TempEmp shall endeavour to ensure that all feedback and ratings are left in accordance with these Terms. Where TempEmp deem comments to be inappropriate, We shall take appropriate action which may include terminating a registration or contacting the relevant authorities.
  5. Disputes
    • Disputes between the Job Seeker and Employer should be dealt with directly between the parties. TempEmp do not have any responsibility or liability to the parties to intervene in any dispute arising from their communication or contact.
    • Job Seekers should understand the contract between them and the Employer before signing up to and accepting any engagement from the Employer. From the time the Employer and Job Seeker engage in an exchange of service, TempEmp no longer have any contact with the parties and all disputes should be resolved between them
  6. Accountability
    • TempEmp do not accept any liability or responsibility for the organising or distribution of payments in lieu of work completed and any dispute between the parties in relation to payment is solely between the Employer and the Job Seeker.
    • TempEmp does not accept any responsibility for the content of jobs, tasks or projects posted on the platform, nor for the content of the profiles registered by Users.
    • TempEmp cannot guarantee the quality of the projects, jobs or tasks advertised, the legitimacy of the Job Seeker or account for the Employer or the job or task in any way whatsoever.
    • TempEmp do not accept any liability whatsoever for the Employers themselves or the jobs or tasks they advertise and Users accept full responsibility for checking the legitimacy of each user they contact.
  7. Responsibility for Content
    • We use Our best endeavours to provide You with a quality service and virus free website. However, We are not responsible for computer viruses or other computer related problems You suffer as a result of using this website, which are beyond Our reasonable control. We recommend that You use Your own appropriate virus checking software.
    • We are not responsible for any commentary, opinions, ratings or other postings on this website by third parties.
    • We do not prevent or exclude Our responsibility to You for death or personal injury resulting from Our negligence.
    • Neither We, nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this Website for any particular purpose.
    • Information provided on this Website may contain inaccuracies or errors and We accept no liability whatsoever to the fullest extent permitted by law, for any such inaccuracies or errors.
    • Whilst we make every effort to ensure that accurate information is uploaded to the Portal, we cannot guarantee this.
  8. Accessing our site
    • Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.
    • You agree that You shall not do anything that affects the integrity or security of this website or causes or may cause harm, damage or unreasonable inconvenience to other users of this website or Us.
    • If You breach any of the clauses set out at above (clause 4), We may take such action as We deem appropriate, including denying You access to this website, bringing legal proceedings against You and disclosing such information to appropriate legal and/or regulatory bodies.
  9. Intellectual property rights
    • We are the owners or the licensees of all intellectual property rights in and on our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
    • You may print off one copy, and may download extracts, of any page(s) from our site for your personal reference and you may draw the attention of others within your organisation to material posted on our site.
    • You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
    • Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.
    • You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors.
    • If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
  10. Advertising
    • TempEmp may, from time to time, advertise other companies on the Portal. These advertisements are independent of TempEmp and TempEmp do not necessarily agree with, promote or condone the content of the advertisements.
    • TempEmp do not accept any responsibility or liability for any content or sites which you are directed to as a result of clicking on an advertisement shown on the Portal or for any third party sites that you may be referred to.
  11. Our site changes regularly
    • We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.
  12. Our liability
    • The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, and third parties connected to us hereby expressly exclude:
      • All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
      • Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including, without limitation any liability for:
    • loss of income or revenue;
    • loss of business;
    • loss of profits or contracts;
    • loss of anticipated savings;
    • loss of data;
    • loss of goodwill;
    • wasted management or office time; and
    • for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.
    • This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.
    • Once You have contacted a service provider and have employed their services you are bound by their independent terms and conditions which are in no way whatsoever connected to TempEmp.
